Definitions
Commercial Gain or Use - refers to an individual, group of individuals, sole proprietor, partnership,
industry body or entity (incorporated or unincorporated) who either intentionally or unintentionally
receive economic gain or competitive advantage for themselves, or their organisation, by using the
information available on the CPRMS Website.
Force Majeure - means an unexpected or disruptive event beyond the reasonable control of
CPRMS that causes commercial loss or damage. Also, commonly referred to as "Acts of God".
Special, Indirect and Consequential Loss - means any loss of profits, production, revenue,
use, contract, opportunity or goodwill; wasted overheads; liability to third parties; payment of liquidated
sums, penalties or damages under any agreement other than this Terms & Conditions; any other loss which is
of a special or consequential nature; and any loss which is an economic loss in respect of any claim in tort.
You or your - refers to an individual, or a representative for a group of individuals,
sole proprietor, partnership, industry body or entity (incorporated or unincorporated) or their
representatives who accesses the Leisure Freight and Import websites.
Website - means the Leisure Freight and Import websites at web addresses - www.leisurefreightandimport.com.au;
www.leisureimportsandfreighttransport.com.au; www.importaboatfromtheusa.com.au; www.importboats.com.au.;
